In the 2016 Federal Budget the Government announced a 40 per cent “diverted profits tax” (DPT) to apply to income years commencing on or after 1 July 2017 applicable to multinational corporations (MNC). This measure is intended to ensure MNCs pay “an appropriate amount of tax on profits made in Australia” and provide greater powers to the Australian Taxation Office (ATO) for taxpayers “who do not co-operate with the ATO”. The DPT is intended to be based on the insufficient economic substance aspect of the DPT which has applied in the United Kingdom since 1 April 2015.
